3. SHIPPING AND DELIVERY OF GOODS
3.1. Unless otherwise agreed in writing between the Customer and the Seller, the Seller shall be obliged to deliver the Goods to the Customer without undue delay, and in any case not later than 30 (thirty) calendar days from the date of conclusion of the Contract, as required by’art. 61 of the Consumer Code.
The delivery costs of the Product, where present, are fully borne by the Customer, and vary according to the weight and volume of the Product, the delivery location and the selected optional services.
Except in the case of Extralarge Products, for which the provisions of paragraph 2.8 shall apply. during the processing of the Order and before the forwarding of the Order by the Customer and the conclusion of the Contract, they are communicated to the Customer in a clear and comprehensible way, all shipping and delivery costs related to the Good object of the Order.
If, in exceptional cases, it is not possible to calculate in advance the delivery costs, the Customer will receive clear evidence of this before forwarding the order and conclusion of the Contract.
3.2. The shipment of the Good will be made by carrier (courier) or in any case through a third party shipping company with respect to the Company and the Seller, which will be indicated on the Site and in the Platform at the time of filling out the Order and before its forwarding, together with the conditions of carriage applied, unless otherwise indicated to the Customer in the Order Confirmation.
With the forwarding of the order the Customer declares to have read and to have accepted the same.
3.3. Together with the order confirmation, the Customer will receive the details for the delivery of the Good and the times, together with the tracking code that will allow to monitor the status of the shipment.
The Customer can verify the transfer phase of the Good:
1. connecting to the MyArea Reserved Area;
2. Directly on the carrier’s website.
3.4. The Good can be delivered throughout the Italian territory at the address indicated by the Customer in the order form. Shipments may not be addressed to mailboxes and postal stoppage.
In case the Customer has made himself unavailable at the delivery of the Good, the Customer will have 30 (thirty) days to proceed to collect the Good at his own expense at the physical headquarters of the Seller. After that period, the Seller may retain the Good and the Customer will lose the right to the refund of the amounts paid.
The Customer, together with the delivery of the Good, must verify the integrity of the same and in case of defects report them to the Seller within 24 hours from the receipt of the package.
3.5. The delivery obligation shall be deemed to have been fulfilled by the transfer of the material availability or, in any case, the control of the Good to the Customer.
If the delivery obligation of the Good is not fulfilled within the time limit specified in paragraph 3.1. , the Customer shall have the right to request that the delivery be made within an additional period appropriate to the circumstances. If this additional period, if granted, expires without the Good having been delivered, the Customer shall have the right to terminate the Contract.
3.6. However, the Customer shall not be burdened with the burden of granting the additional period referred to above, if:
a) the Seller has expressly refused to deliver the Good, that is;
b) the respect of the term agreed by the parties for the delivery of the Good must be considered essential, taking into account all the circumstances that have accompanied the conclusion of the contract, that is;
c) the Customer has informed the Seller in writing, before the conclusion of the contract, that delivery within or at a given date is to be considered essential.
3.7. The Customer has the right to terminate the contract, without prejudice to the right to compensation for damages, if he does not receive the Good within the agreed period or within the period referred to in paragraph 3.1.. In such a case, he shall be entitled to reimbursement of any sums paid under the contract.
4. PICK UP IN STORE
4.1. Without prejudice to the purchase procedure provided for in art. 2, the Customer has the possibility, if indicated, to collect the Good directly at the physical location and/or the Seller’s shop, at his own care and expense and without delivery costs, making an express request in the order form.
4.2. In order to collect the Good, the Customer must present his own document of identity (or possibly that of the person who made the purchase), together with the printing of the communication of email attesting the confirmation of the Order, no later than 30 (thirty) calendar days from the date of receipt of the Notice of Acceptance of the Order.
4.3. In such case, the time limit for annulment referred to in art. 7, if it exists, it will begin from the day of actual taking over of the Good by the Customer, that is from the day on which the Customer should take over the Good according to the previous paragraph.
4.4. If the Customer does not collect the Good at the Seller’s physical office and/or shop within 30 (thirty) calendar days from the date of receipt of the Order’s acceptance notice, the Seller will be exempt from the obligation to deliver the Good and/or to guarantee its availability.
